Terms of Service

These Terms of Service ("Terms") govern your use of erikleephotography.com (the "Site") and the photography services provided by Cross Forward Media LLC, doing business as Erik Lee Photography ("Erik Lee Photography," "we," "us," or "our"). By using our Site or engaging our services, you agree to these Terms.

Please note: When you book a session, event, or project, you will receive a separate written service agreement specific to that engagement. That signed agreement governs the details of your booking and takes precedence over these Terms wherever the two differ.

1. Our Services

Erik Lee Photography provides event, wedding, portrait, and travel & destination photography services in the Dallas–Fort Worth metroplex and worldwide. The specific scope, deliverables, timeline, and price for any engagement are set out in your individual service agreement and any accompanying quote or invoice.

2. Enquiries, Booking & Payment

  • Submitting an enquiry does not create a booking. A date is reserved only when a signed agreement and any required retainer or deposit are received.
  • A [non-refundable retainer / deposit of __%] is typically required to reserve your date, with the balance due [on or before the date of the session/event, or per the schedule in your agreement].
  • Quoted fees may not include applicable taxes, travel, lodging, permits, or other expenses, which will be identified in your quote or agreement.
  • Late payments may result in delayed delivery, suspension of services, or additional fees as described in your agreement.

3. Cancellation & Rescheduling

  • Any retainer or deposit paid to reserve your date is [non-refundable], as it compensates us for holding the date and turning away other work.
  • If you need to reschedule, we will make reasonable efforts to accommodate a new date subject to availability. [State any rescheduling window or fee here.]
  • If we must cancel or cannot perform due to illness, emergency, or circumstances beyond our reasonable control (see Section 10), we will make reasonable efforts to arrange a suitable replacement or reschedule; if we cannot, our liability is limited as described in Section 9 and your agreement.

4. Copyright & Ownership of Images

Unless your signed agreement expressly states otherwise, Erik Lee Photography retains all copyright and ownership of all photographs and media we create. This is the standard practice under U.S. copyright law, under which the photographer owns the copyright by default.

We grant you a license to use your delivered images as described in Section 5. We do not transfer copyright unless a separate written copyright-transfer or work-for-hire agreement is signed and any applicable fee is paid.

5. Your License to Use the Images

Upon full payment, and unless your agreement states otherwise, we grant you a non-exclusive, non-transferable license to use your delivered images for personal, non-commercial use — including printing, sharing with family and friends, and posting to your personal social media.

  • Commercial or promotional use (advertising, brand marketing, resale, or use by a business) requires a separate commercial license, which may carry an additional fee. This is common for event and business clients — just ask and we'll arrange appropriate terms.
  • You may not sell, license, or claim authorship of the images, or alter them beyond ordinary cropping without our written permission.
  • When sharing images publicly, please do not apply filters or edits that materially change the work, and credit "Erik Lee Photography" where practical.

6. Model Release & Our Use of Images

Unless you notify us in writing before your session or event, you grant Erik Lee Photography the right to use images from your engagement in our portfolio, website, social media, and marketing materials.

  • If you prefer that your images not be used for these purposes, tell us in writing and we will honor that request.
  • For events, you are responsible for informing your guests that photography will take place. Where images of identifiable individuals are used for commercial or advertising purposes, additional model releases may be obtained as appropriate.
  • Where recognizable private property is featured, a property release may be appropriate.

7. Delivery of Images

Your final images are delivered as an expertly edited digital gallery on the schedule set out in your agreement [state your standard turnaround, e.g. "typically within __ weeks"]. Editing is performed in our professional style; the number of final images and level of retouching are as described in your agreement. Unedited or raw files are not delivered.

8. Client Responsibilities

  • Provide accurate details, timely communication, and reasonable cooperation before and during your engagement
  • Secure any necessary venue permissions, permits, or access we need to perform
  • Ensure a safe working environment at the location
  • Make timely payment as agreed

9. Limitation of Liability

To the fullest extent permitted by law, our total liability arising out of or relating to any engagement is limited to the amount you paid us for that engagement. We are not liable for indirect, incidental, or consequential damages. In the unlikely event of equipment failure, data loss, or other circumstances that prevent full delivery, our liability is limited as stated here and in your agreement. We are not responsible for missed images due to obstructions, guest interference, venue restrictions, or conditions beyond our control.

10. Circumstances Beyond Our Control

We are not liable for failure or delay in performance caused by circumstances beyond our reasonable control, including illness, injury, severe weather, natural disaster, travel disruption, venue closure, acts of government, or other events of force majeure. In such cases we will make reasonable efforts to reschedule or arrange a suitable alternative.

11. Site Use & Intellectual Property

All content on this Site — including images, text, design, and logos — is owned by or licensed to Cross Forward Media LLC and is protected by intellectual property laws. You may not copy, reproduce, or use any Site content without our written permission.

12. Governing Law & Disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising under these Terms or an engagement will be handled in the state or federal courts located in Tarrant County, Texas, unless your service agreement specifies an alternative such as mediation or arbitration. 13. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted, and we will revise the "Last updated" date above. Your continued use of our Site or services after changes are posted constitutes acceptance of the updated Terms.
